The Employee Relations investigative unit will be responsible for the investigation and resolution of all cases related to Title VII and other complex and high-profile issues with potential for significant enterprise impact.

The ER Investigative Consultant role manages Title VII issues for managers and employees in entry to mid-level roles and may assist ER Investigation Managers with cases involving more senior level employees/leaders as needed. The role may also handle other investigation types as determined appropriate.

ER Investigative are responsible for triaging, investigating and resolving complaints from employees related to discrimination, harassment, accommodation, and other complex, serious issues. Using information from employee and management complaints and/or other relevant information conducts confidential investigations and documents relevant findings and reports any illegal or inappropriate activities in accordance with all laws and regulations and/or company policy. Responsibilities include: virtual and/or onsite interviews to gather and analyze all necessary information and documents related to the investigation, critical thinking and decision making to identify recommended actions for resolution, and effective communication of findings to key stakeholders. Where applicable, testimony regarding the investigation may be required. Role may also require completion of a root cause analysis.

This position partners with ER Investigation Managers and ER Case Management colleagues to ensure compliance with laws and regulations as well as collaborates and advises business leaders on outcomes and decisions. Strives to incorporate innovative thinking and works collaboratively to ensure best practice investigative techniques and protocols.

Primary Responsibilities:

Data Gathering / Analysis

  • Gather all relevant facts to drive investigations (e.g., case history, performance history, employment history)

  • Analyze data and facts gathered to determine relevance and applicability to the investigation

  • Review applicable historical documentation to identify issues / events relevant to the investigation

Conduct Investigations and Assist with Investigative Process

  • Develop / communicate rationale and plans for investigations throughout the lifecycle (e.g., allegation to resolution)

  • Apply knowledge of policies, practices, laws and regulations

  • Collaborate with internal business partners to help drive the investigation process

  • Serve as a liaison among all stakeholders in the investigation to ensure awareness and alignment

  • Recommend / implement improvements to investigation processes

Effectuate Case Resolution and Propose Recommendations

  • Negotiate with applicable stakeholders to ensure and validate appropriate actions taken during the investigation process

  • Recommend level/type of corrective action / remediation if appropriate

  • Collaborate with applicable internal partners to obtain approvals for investigation resolutions

Prepare Appropriate Documentation and Communication

  • Utilize appropriate systems to monitor and document status of investigations, and take action as needed

  • Communicate clear rationale/justification for investigation processes and outcomes to appropriate stakeholders

  • Prepare documentation as needed for external legal/regulatory agencies

  • Document and report

  • Provide ongoing reporting and analysis of investigations to all applicable stakeholders, as needed


  • Ensure compliance with employment laws, regulations and company policies and practices

  • Stay current on relevant compliance updates and investigation best practices

Required Qualifications:

  • Undergraduate degree or equivalent experience

  • 6+ years of employee relations experience

  • 2+ years of experience investigating employment related issues

  • Knowledge of state and federal employment law including specific knowledge in Title VII, ADAA, EEO

  • Ability to travel regionally as required, likely 25%-50%

  • You will be asked to perform this role in an office setting, however, may be required to work from home temporarily due to space limitations

  • Employees are required to screen for symptoms using the ProtectWell mobile app, Interactive Voice Response (i.e., entering your symptoms via phone system) or a similar UnitedHealth Group-approved symptom screener prior to entering the work site each day, in order to keep our work sites safe. Employees must comply with any state and local masking orders. In addition, when in a UnitedHealth Group building, employees are expected to wear a mask in areas where physical distancing cannot be attained
